So a better analogy would be not "giving Stephen Ambrose an exclusive right to D-Day" but that he might have a case if a novel covers the same events he covers in the same order and doesn't mention any significant events Ambrose doesn't cover, even if the novel invents new dialogue, new fictional characters, and so on.
