Regarding “AI Leaders Are Standing on a Liability Landmine” (Heard on the Street, Sept. 23), Palantir CEO Alex Karp’s key proposition in a recent CNBC interview was the opposite of nationalizing the risk of loss, namely “the first line of defense is you’re liable for your own actions.”

Mr. Karp is right that AI developers should remain subject to civil liability for the systems they create, but he doesn’t go far enough. Directors of Delaware corporations owe fiduciary duties that include a duty of oversight and can face personal liability when they act in bad faith by consciously disregarding sufficiently serious “red flags” concerning risks to the corporation.
